Foreign wills
Although foreign wills are recognised in Spain it is always advisable that clients draw up a separate Spanish will in respect of assets based in Spain. The main advantage being that the Spanish estate can then be administered quickly and cost effectively.
Inheritance Tax
Inheritance tax is payable if either the inheritor (i.e. the recipient or heir) is a resident of Spain or if the asset passing on death is located in Spain.
t is important to note in Spain there is no exemption between a husband and wife and where both are resident of Spain then the surviving spouse is fully liable to inheritance tax on the worldwide assets of the deceased spouse.
